University of Florida Intellectual Property Policy

The University of Florida Intellectual Property Policy is the primary governing document of the University of Florida with regard to intellectual property protection. Central to the purpose of the University of Florida are teaching, research, and service. Research is undertaken to educate students, to stimulate a spirit of inquiry, to solve problems, and to discover new knowledge. Patentable inventions and other marketable forms of intellectual property may result from research conducted by personnel of the University. The University of Florida believes that a university has an obligation to serve the public interest by insuring that such intellectual property is appropriately developed and protected. As such, the University of Florida Intellectual Property Policy is meant to encourage and enable technology development and transfer for the benefit of the public.

The IFAS Policy Governing Release, Protection and Introduction of Plant Material provides general guidelines regarding the approval and release of new cultivars developed by the Florida Agricultural Experiment Station (FAES). From the point at which a breeder develops a cultivar that he/she wishes to release, the IFAS Policy Governing Release, Protection, and Introduction of Plant Material details chronologically the entire release process, from initial approval for release, to protection, commercial licensing, and the distribution of royalties.

The University of Florida/IFAS Policy for Program Support and Royalty Distribution from Released Cultivars details how royalties that accrue on cultivars developed by the Florida Agricultural Experiment Station (FAES) are distributed among Florida Foundation Seed Producers, Inc. (FFSP), breeding programs working to develop new cultivars, and individual breeders and cooperators. The goal of the policy is to insure strong, sustainable plant breeding/development programs in UF/IFAS/FAES. As such, a majority of royalties received go back to the plant breeding/development programs to fund further research.
